1. Who we are

Hysplex is an online service, run by Layernine Ltd, that lets its members plan running routes and runs in their city, join runs that other members have planned, and share how those runs went. Layernine Ltd is a company registered in England and Wales (company number 14628201), with its registered office at 128 City Road, London, EC1V 2NX. In these terms, “Hysplex”, “we”, “us” and “our” mean Layernine Ltd, and “you” means you, the person using Hysplex. You can reach us at hello@layernine.co.uk.

2. Who can use Hysplex, and your account

You must be at least 18 years old and able to enter a contract to use Hysplex. When you sign up you pick your city, and your chapter is every member in that city.

• You must give accurate information when you sign up, and keep it current.
• Your account is personal to you. You are responsible for keeping your password safe, and for everything done through your account.
• Tell us promptly at hello@layernine.co.uk if you think someone else has got into your account.

3. Running is at your own risk

This is important. Running and other physical activity carry risks to your health and safety. Runs planned through Hysplex are organised by members, for members. They are not supervised, coached or marshalled events run by us, and we do not check routes, go along on runs, or provide first aid.

• You take part in any run, and use any route, entirely at your own risk, and you are responsible for your own safety and your own decisions.
• You should be in good enough health to run, and should get medical advice if you are unsure. It is for you to decide whether a run or a route is right for you.
• You are responsible for following the law and the rules of the road, and for respecting other people and places while you run.
• Routes are drawn by members and may be wrong, incomplete or unsafe. Always use your own judgement on the ground.

4. How you must behave

Hysplex only works if members treat each other, and the service, with respect. You agree that you will not:

• post content that is unlawful, harassing, abusive, misleading, or that infringes anyone’s rights;
• pretend to be someone else, or misuse another member’s information;
• use Hysplex for anything other than its intended purpose, or in a way that harms the service or other members;
• try to break, probe or get around the security of the service, or reach data you are not meant to.

5. Content you create

You keep ownership of the routes, runs, results and notes you create. By posting them, you give us permission to store, display and share that content within your chapter, so that Hysplex can work as it is meant to. You are responsible for the content you post, and you confirm you have the right to post it. We may remove content that breaks these terms.

6. Ending your account

You can stop using Hysplex at any time by deleting your account from your settings, or by contacting us at hello@layernine.co.uk. When you delete your account, your personal details are removed as described in our Privacy Policy, and the shared routes and runs you created stay with your chapter under the name “Past member”.

We may suspend or close your account if you break these terms, or if we reasonably need to in order to protect the service or other members. Where it is fair to do so, we will give you notice first.

7. The service

We work to keep Hysplex available and running well, but we provide it as it is, and we cannot promise it will always be available, uninterrupted or free of faults. We may change, add to, or remove features, and we may pause the service for maintenance.

8. Our responsibility to you

Nothing in these terms limits or excludes our liability where it would be unlawful to do so, including our liability for death or personal injury caused by our negligence, or for fraud. Your legal rights as a consumer are not affected by these terms.

Subject to that, we are not liable for loss or damage that is not a reasonably foreseeable result of our breaking these terms, for loss arising from runs or routes that members organise, or for business losses, since Hysplex is provided to you for personal use. Where we are liable to you, our total liability for all claims is limited to £100.

9. Privacy

How we handle your personal information is set out in our Privacy Policy, which forms part of these terms.

10. Changes to these terms

We may update these terms from time to time. When we make a significant change, we will tell members, and we will update the “last updated” date above. If you do not agree to a change, you can stop using Hysplex and delete your account.

11. Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute, although if you live elsewhere in the UK you may bring a claim in the courts of the country you live in.
